These laws also limit a mother\u2019s ability to make decisions about the upbringing of her own child.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>The Law:<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Articles 123, 124 and 125 of Lebanon\u2019s Personal Status Law of the Catholic Sects, 1949 provide that the rights and duties of parental authority (apart from breastfeeding) are confined to the father, and that a mother loses custody of her child upon re-marriage while the same restriction does not apply to the father.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Article 123:\u00a0<em><strong>Breastfeeding concerns the mother. The other rights and duties of the parental authority are, in principle, confined to the father.<\/strong>\u00a0These rights and duties are passed to the mother if the father is deprived from these responsibilities provided that the mother is proved to be eligible by the court and the court provides the mother a notice about the transfer of these responsibilities to her.<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:quote --> <!-- wp:quote --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Article 124:\u00a0<em><strong>The duration of breastfeeding is two years<\/strong><\/em>.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:quote --> <!-- wp:quote --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Article 125:<em><strong>\u00a0A mother<\/strong>\u00a0loses custody of her child for the following:<\/em><br \/>\n<em>A: if she is recalcitrant, or behaving badly<\/em><br \/>\n<em>B: if she is not capable of raising and rearing her child<\/em><br \/>\n<em>C: if she caused the lack of joint marital life<\/em><br \/>\n<em>D:if she changes her religion, or changes her Catholic sect<\/em><br \/>\n<em>E: if\u00a0<strong>she remarries<\/strong>\u00a0after the dissolution of the marriage, or the death of her husband.<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Note:<\/strong>\u00a0Article 7 of the Constitution of the Republic of Lebanon:\u00a0<em><strong>All Lebanese are equal before the law.<\/strong>\u00a0They equally enjoy civil and political rights and equally are bound by public obligations and duties without any distinction.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.legallaw.ul.edu.lb\/LawView.aspx?opt=view&amp;LawID=258198#Section_287150\" target=\"_blank\" rel=\"noreferrer noopener\">Explore Lebanon&rsquo;s full law<\/a><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n    \n<\/div>\n\n\n\n\n<div class=\"text-signpost-block\">\n    <div class=\"container\">\n\n        \n    <\/div>\n<\/div>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":5,"featured_media":0,"menu_order":0,"template":"","post_tag":[],"resource_type":[],"law_status":[216],"law_type":[223],"issue":[49],"region":[26],"class_list":["post-1753","resource","type-resource","status-publish","hentry","issue-achieve-legal-equality"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.3 (Yoast SEO v27.3) -
