href=\"https:\/\/equalitynow.org\/\"> Equality Now<\/a> and Moldovan organisations <a href=\"https:\/\/www.eupot.md\/\">AEFL Moldova<\/a>,<a href=\"https:\/\/motivatie.md\/ro\/\"> Association \u201cMOTIVATIE<\/a>\u201d of Moldova,<a href=\"https:\/\/bit.ly\/3UK6Q1y\"> Women in Legal Career<\/a>,<a href=\"https:\/\/www.facebook.com\/femeipfemei\"> Femei pentru Femei<\/a>,<a href=\"https:\/\/www.facebook.com\/ffuplm\/?locale=ro_RO\"> FFUPLM<\/a> and<a href=\"https:\/\/romawom.org\/roen\"> Moldsolidaritate<\/a> submitted a joint report on gender-based violence against women and girls. Moldova ratified the<a href=\"https:\/\/www.coe.int\/en\/web\/conventions\/full-list?module=signatures-by-treaty&amp;treatynum=210\"> Istanbul Convention<\/a> in 2022 and has since legislated on femicide, forced marriage and digital violence, but its laws still fall short of CEDAW and Istanbul Convention standards. Survivors, particularly Roma women and girls, women and girls with disabilities and refugee women and girls, face persistent barriers to protection, justice and reparation.<\/p>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n    \n<\/div>\n\n\n\n<div class=\"two-column-content-block\">\n\n    \n        <div class=\"container\">\n            <div class=\"columns is-multiline\">\n                <div class=\"column is-12-tablet is-6-desktop is-5-fullhd\" data-aos=\"fade-right\">\n\n                                                                    <a name=\"what\u2019s-included-in-the-submission?\"><\/a>\n                    \n                                            <div class=\"title-block\">\n                            <div class=\"outer\">\n                                <div class=\"inner left\">\n                                    <h2>\n                                        What\u2019s included in the submission?                                    <\/h2>\n                                <\/div>\n                            <\/div>\n                        <\/div>\n                    \n                    <p>This submission assesses the Republic of Moldova\u2019s progress since the CEDAW Committee\u2019s 2020 concluding observations, measured against the Convention, General Recommendations No. 33 and No. 35, the Istanbul Convention and GREVIO\u2019s 2023 baseline evaluation. It documents that complaints concerning violent crimes involving family members more than doubled between 2018 and 2025 (from 11,026 to 23,727) while convictions stayed flat (1,919 in 2018; 1,855 in 2025), and that no application for state compensation had been filed since that mechanism opened in 2018.<\/p>\n<p>On sexual violence, the submission finds that the 2022 amendment to Article 171 of the Criminal Code still ties the absence of consent to coercion or the victim\u2019s inability to resist, rather than treating free and voluntary consent as the defining element. On child and forced marriage, it notes that Article 14 of the Family Code still permits marriage below 18 in certain circumstances, that a November 2025 amendment removed independent guardianship-authority review, and that the new forced-marriage offence (Article 167 1) covers only violence or threats of violence.<\/p>\n<p>The submission also addresses the situation of women and girls facing multiple and intersecting discrimination, including Roma women and girls, women and girls with disabilities, women returning after migration and refugee women and girls, and draws on two recent European Court of Human Rights judgments against Moldova, <a href=\"https:\/\/hudoc.echr.coe.int\/#%7B%22itemid%22:[%22001-238017%22]%7D\">Vieru (2024)<\/a> and <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-241986\">I.C. (2025)<\/a>, on ineffective investigation and the failure to protect women from violence. It closes with recommendations to the Committee grouped under legislative framework, justice and accountability, and intersecting forms of discrimination.<\/p>\n\n                <\/div>\n aria-level=\"1\">Amend Articles 171 and 132\u00b2 of the Criminal Code so that rape and other sexual offences are defined by the absence of free and voluntary consent, in line with CEDAW General Recommendation No. 35 and Article 36 of the Istanbul Convention, without requiring proof of coercion, resistance or the victim\u2019s inability to resist.<\/li>\n<li aria-level=\"1\">Amend Article 14 of the Family Code to set 18 as the minimum age of marriage with no exceptions, and enforce the provisions on child and forced marriage.<\/li>\n<li aria-level=\"1\">Amend Article 167 1 of the Criminal Code so that forced marriage covers all forms of coercion, including psychological, economic, family and social pressure, and remove the requirement to prove the perpetrator knew the victim was a child.<\/li>\n<li aria-level=\"1\">Amend Articles 159 and 160 of the Criminal Code to criminalise abortion and sterilisation performed without prior, full, free and informed consent, with safeguards for women and girls with psychosocial or intellectual disabilities.<\/li>\n<li aria-level=\"1\">Implement the new femicide provisions consistently, and collect and publish disaggregated data on femicide, sexual violence, digital violence and compensation so that the impact of recent reforms can be assessed.<\/li>\n<li aria-level=\"1\">Provide mandatory, regular and specialised training on the prevention, identification, investigation, prosecution and adjudication of gender-based violence for police officers, prosecutors, judges, lawyers, health-care personnel, social workers and other professionals working with survivors.<\/li>\n<li aria-level=\"1\">Integrate an intersectional perspective into all gender-based violence policies: guarantee Roma women\u2019s access to justice and services, make shelters and justice procedures accessible to women with disabilities (including mothers with children with disabilities), and ensure refugee women can report violence without
