Third-party intervention in Kurt v. Austria (ECtHR)

Summary

Equality Now and the European Human Rights Advocacy Centre have been granted leave to intervene in Kurt v. Austria – a potentially landmark case at the Grand Chamber of the European Court of Human Rights.

On 6 February 2020, we submitted a joint Third-Party Intervention in this case.

The submission re-conceptualises the obligations of the State to safeguard life and safety in the context of domestic violence. The submission also examines the necessity for the Court to adopt a gender perspective in cases of violence against women, including marital rape.

The Grand Chamber of the European Court of Human Rights will hold a public hearing on the case on 4 March 2020, during which the parties will respond to the third-party submission.

Equality Now, with partners, submitted an amicus curiae to Chile’s Constitutional Court defending Article 12 of the Bill, which ensures non-sexist, gender-equal education and the prevention of gender-based violence in schools, urging the Court to affirm its constitutionality and support policies promoting gender equality in education.
