Third-Party Intervention in Kurt v. Austria (ECtHR)

Key takeaways and recommendations

Equality Now and the European Human Rights Advocacy Centre have been granted leave to intervene in Kurt v. Austria – a potentially landmark case at the Grand Chamber of the European Court of Human Rights.

On 6 February 2020, we submitted a joint Third-Party Intervention in this case.

The submission re-conceptualizes the obligations of the State to safeguard life and safety in the context of domestic violence. The submission also examines the necessity for the Court to adopt a gender perspective in cases of violence against women, including marital rape.

The Grand Chamber of the European Court of Human Rights will hold a public hearing of the case on 4 March 2020, where the parties will respond to the Third Party submission.
