They are essentially subject to state-sanctioned rape and are at risk of increased domestic violence, forced pregnancy, and negative health consequences while being denied education and economic opportunity.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p><strong>Laws prohibiting child marriage for both girls and boys,<\/strong>\u00a0without any exceptions, are needed to make explicit the States\u2019, and societies\u2019 understanding that young people need time to understand their independent circumstances before entering into a lifelong contract that will affect many aspects of their lives.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:paragraph --><\/p>\n<p><strong>Update:<\/strong> The Zambian Parliament passed the <a href=\"https:\/\/www.parliament.gov.zm\/sites\/default\/files\/documents\/acts\/Act%20No.%2013%20of%202023%2C%20The%20Marriage%20%28Amendment%29%20Act.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Marriage Amendment Act No. 13 of 2023<\/a> on 22 December 2023. The Act brings the minimum age of marriage to 18 (as a child is defined as 18 in the Constitution) without exception, and crucially removes the exception for customary marriages. <a href=\"https:\/\/equalitynow.org\/press_release\/illegal-to-marry-below-18-zambia-passes-the-landmark-marriage-amendment-act-2023\/\">Learn more<\/a> about the new law and the advocacy undertaken by Equality Now and our partner Generation Alive in support of the amendments.<\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:heading --><\/p>\n<h2 class=\"wp-block-heading\">The Law:<\/h2>\n<p><!-- \/wp:heading --> <!-- wp:paragraph --><\/p>\n<p><strong>Sections 17 and 34 of Zambia\u2019s Marriage Act exempt all marriages under any African customary law from the minimum age of marriage requirements (normally 21 years) under the law. There is no minimum age of consent to marry under Zambian customary law as current customary practice allows any girl who attains puberty to get married.<\/strong><\/p>\n<p><!-- \/wp:paragraph --> <!-- wp:quote --><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><!-- wp:paragraph --><strong>17. I<em>f either party to an intended marriage,<\/em><\/strong><em>\u00a0not being a widower or widow,\u00a0<strong>is under twenty-one years of age, the written consent of the father,<\/strong>\u00a0or if he be dead or of unsound mind or absent from Zambia, of the mother, or if both be dead or of unsound mind or absent from Zambia, of the guardian of such party shall be produced.<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/blockquote>\n<p><!-- \/wp:quote --> <!-- wp:quote --><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><!-- wp:paragraph --><strong>34.<\/strong>\u00a0<em>Any person who is married under this Act or whose marriage is declared by this Act to be valid, shall be incapable during the continuance of such marriage of contracting a valid marriage under any African customary law, but, save as aforesaid,\u00a0<strong>nothing in this Act contained shall affect the validity of any marriage contracted under or in accordance with any African customary law<\/strong>, or in any manner apply to marriages so contracted.<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/blockquote>\n<p><!-- \/wp:quote --> <!-- wp:quote --><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><!-- wp:paragraph --><strong>Zambia\u2019s Response to List of Issues and questions with regard to the Combined Fifth and Sixth Periodic Reports to the United Nations Committee on the Elimination of Discrimination Against Women (2011):<\/strong><br \/>\n<em>The State party reports that there is\u00a0<strong>no minimum age of consent to marry for women under customary law.<\/strong>\u00a0This is because the current customary practice allows any girl who attains puberty to get married.<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/blockquote>\n<p><!-- \/wp:quote --> <!-- wp:paragraph --><\/p>\n<p><strong>Note:<\/strong>\u00a0Customary law, which is explicitly excluded from the purview of the Marriage Act, is not codified in writing.
