Despite the testimonies of eyewitnesses who confirmed the victim&#8217;s inability to move due to excessive alcohol consumption and directly observed the act, only three of the six aggressors were prosecuted and subsequently acquitted.<\/p>\n<p><!-- \/wp:list --><\/p>\n\n                <\/div>\n            <\/div>\n        <\/div>\n\n    \n<\/div>\n\n\n\n<div class=\"two-column-content-block\">\n\n    \n        <div class=\"container\">\n            <div class=\"columns is-multiline\">\n                <div class=\"column is-12-tablet is-6-desktop is-5-fullhd\" data-aos=\"fade-right\">\n\n                                                                    <a name=\"what's-in-it?\"><\/a>\n                    \n                                            <div class=\"title-block\">\n                            <div class=\"outer\">\n                                <div class=\"inner left\">\n                                    <h2>\n                                        What&#8217;s in it?                                    <\/h2>\n                                <\/div>\n                            <\/div>\n                        <\/div>\n                    \n                    <ol>\n<li><strong>Lack of gender perspective: <\/strong>The criminal process failed to incorporate a gender perspective, neglecting the context of discrimination and structural inequality faced by women in various spheres of society, including the unequal power relations between the victim and the perpetrators.<!-- \/wp:list-item --><br \/>\n<!-- wp:list-item --><\/li>\n<li><strong>Institutional violence and gender stereotypes: <\/strong>The court&#8217;s decision was based on gender stereotypes that place responsibility on the victim, contravening international standards on due diligence and empathetic neutrality. Notably, one of the judges stated that women &#171;often deserve to be raped&#187; based on their conduct, attitude, and behaviour, which is unacceptable and demonstrates a clear violation of the victim&#8217;s rights.<\/li>\n<li><strong>Incorrect presumption of consent:<\/strong> The court ignored key evidence regarding the unconscious state of M.S. from alcohol consumption, which impaired her volitional capacity, preventing free and conscious consent.
