Equality Now’s new book explores distribution of marital property under international and Islamic law

Equality Now and the Women’s Center for Legal Aid and Counseling in Palestine published the book, »The Distribution of Marital Property after the End of a Marriage under International and Islamic Law » by Nasser El-Rayes, which is a comprehensive analysis of the laws in Arab countries concerning the division of joint matrimonial wealth after marriage.

Key recommendations

The book compares laws in various Arab countries focusing on Tunisia, Morocco, Algeria, and Palestine, regarding the distribution of joint matrimonial wealth between spouses after the marital relationship has ended. It explores the doctrinal sources in Sharia (Islamic law) which deal with the subject, and includes an analysis of the arguments for and against the equitable distribution of matrimonial wealth in Islam, along with an overview of laws in selected non-Arab countries where this right has been applied in line with the supporting opinions in fiqh (Islamic jurisprudence).
