Advocacy framework for withdrawing reservations to some provisions of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Women in Africa

This Advocacy Framework, developed by the Special Rapporteur on the Rights of Women in Africa in collaboration with Equality Now and the Solidarity for African Women’s Rights (SOAWR) Coalition, provides guidance to support the withdrawal of reservations to the Maputo Protocol. While the Protocol has been widely ratified, with nine countries yet to ratify it, reservations continue to limit the full realisation of women’s rights. Nine AU Member States have placed reservations on some provisions of the Maputo Protocol, and the Framework outlines practical, stakeholder-specific approaches to support the withdrawal of these reservations and to strengthen advocacy efforts to advance the full implementation of the Protocol across the continent.

What’s inside the report?

  • Overview of reservations in international law and regional law, specifically the Maputo Protocol
  • Analysis of how reservations undermine women’s rights across key areas, including marriage, inheritance and reproductive health
  • Mapping of States that have entered reservations and the provisions affected
  • Practical guidance for withdrawing reservations across different stakeholder groups
  • Stakeholder-specific approaches for governments, AU bodies and mechanisms, AU decision-making bodies, international human rights mechanisms, national human rights institutions and civil society
  • Case examples demonstrating that withdrawal of reservations is possible and impactful
  • Strategic entry points for advocacy, legal reform and accountability

Who’s it for?

  • Policymakers and government officials in African Union Member States
  • African Union decision-making bodies, and international and regional human rights mechanisms
  •  National human rights institutions
  • Civil society organisations and advocates working on women’s rights and legal reform

Key takeaways and recommendations

The Framework emphasises that withdrawing reservations is essential to ensure the full and effective implementation of the Maputo Protocol and to advance gender equality across Africa.

Key priorities include:

  • Advance full ratification and implementation without reservations: States should ratify or accede to the Maputo Protocol without reservations and prioritise the withdrawal of existing reservations to ensure women can fully exercise their rights.
  • Recognise that reservations undermine rights and legal protections: Reservations that modify or exclude provisions limit access to rights related to marriage, inheritance, equality and sexual and reproductive health.
  • Strengthen national processes for withdrawal of reservations: Governments should establish inclusive, participatory processes involving parliament, institutions and the public to review and withdraw reservations.
  • Use reservations only as a temporary measure: Where reservations exist, treat them as interim, with clear timelines and procedures for withdrawal.
  • Reject justifications based on domestic law or cultural relativism: Reservations should not be used to justify limiting universally recognised human rights.
  • Enhance accountability through regional and international mechanisms: African Union institutions, human rights mechanisms, and decision-making bodies should actively monitor, review, and call for the withdrawal of reservations.
  • Strengthen advocacy and evidence-based engagement: Civil society organisations should use research, data and lived experiences to drive advocacy and influence decision-making.
  • Promote coordinated, multi-stakeholder action: Effective withdrawal of reservations requires collaboration between governments, regional bodies, civil society and international actors.
