Latin America and the Caribbean, survivors of sexual violence face enormous challenges in their pursuit of justice. Those who choose to report are often subjected to long, painful, and re-traumatizing processes. What can we learn from those who have gone through the system, and from the people working to change it?

JUSTAS, el camino de las sobervivientes (JUSTAS, The Journey of Survivors) is a new Spanish-language video podcast co-produced by Equality Now and the Fundación Thelma Fardin. It opens space for this urgent conversation. Through honest, sensitive, and accessible dialogues, the series explores the many barriers faced by survivors and highlights ways to transform justice systems with a feminist, regional, and survivor-centered approach.

The conversations are hosted by Thelma Fardin, an Argentinian actress, activist, and survivor, and co-hosted by Sofía Quiroga, Advocacy Officer at Equality Now, and Mónica Bayá, Legal Advisor at Equality Now.

The podcast features voices from Argentina, Bolivia, Colombia, Ecuador, Mexico, Puerto Rico, and Uruguay. Survivors, judges, prosecutors, psychologists, and activists come together to address key topics, such as the challenges survivors face when reporting, sexual violence in digital spaces, intersectionality and discrimination, gender-sensitive judicial processes, access to justice for girls and adolescents, reparation pathways, and the role of collective action.

JUSTAS not only exposes the systemic barriers that survivors face, but also seeks to break the culture of silence that surrounds sexual violence in Latin America and the Caribbean.

The series includes five episodes. The first is now available on Spotify and YouTube. New episodes will be released weekly.

A Shared Effort to Amplify Voices and Transform Justice

In 2018, Thelma Fardin publicly reported that she had been raped in 2009 by actor Juan Darthés while on tour with a television show. She was 16 years old at the time, and he was 45. Her testimony encouraged many other survivors to speak out. In the months that followed, official data showed a 53 percent increase in reports of child sexual abuse in Argentina.

In 2023, Equality Now began collaborating with Thelma Fardin on a number of advocacy initiatives. One of them was the submission of an amicus brief in her legal case in Brazil, urging the court to apply international human rights standards on consent in sexual violence cases. These standards include those established by the Inter-American Court of Human Rights in the Brisa de Angulo v. Bolivia case, which Equality Now litigated together with Brisa and her legal team.

As part of this journey, Thelma created the Fundación Thelma Fardin, turning her personal experience into a collective tool for change. The foundation supports survivors, raises awareness about the impacts of sexual abuse, and advocates for a justice system that does not re-victimize those who report.

The idea for the podcast grew out of an ongoing dialogue between Thelma and Equality Now. Together, we decided to create a platform that would bring together the voices of those who confront, reflect on, and work to transform the justice system in Latin America and the Caribbean.

Many of the guests featured in JUSTAS are long-standing allies in Equality Now’s work to reform justice systems in the region. Several are also members of the Regional Access to Justice Network, an initiative launched by Equality Now in 2023. This network brings together legal professionals, justice system officials, and activists from across the region to exchange good practices, strengthen advocacy efforts, and promote legal reforms centered on survivors.

Our goal is to highlight the barriers they face and support the development of good practices by connecting the perspectives of civil society and the justice system. JUSTAS is a way to expand the work we have been doing with justice system actors and share it with a wider audience. The podcast also shows that, although the guests come from different countries, they share common experiences, challenges, and demands. Every country in Latin America and the Caribbean has an outstanding debt when it comes to justice for survivors. This video podcast also reflects Equality Now’s strategy to make legal advocacy more accessible. Through this format, we aim to turn international human rights standards into a shared and practical language for survivors, communities, and justice professionals who are pushing for meaningful change.

Lanzamos JUSTAS, el camino de las sobrevivientes: el videopodcast de Equality Now y la Fundación Thelma Fardin

En América Latina y el Caribe, las sobrevivientes de violencia sexual enfrentan múltiples desafíos para acceder a la justicia. Quienes deciden denunciar enfrentan procesos largos, dolorosos y muchas veces revictimizantes. ¿Qué podemos aprender de quienes ya enfrentaron el sistema y de todas aquellas personas que, desde dentro y desde fuera, trabajan para transformarlo?

JUSTAS, el camino de las sobrevivientes es un nuevo video podcast coproducido por Equality Now y la Fundación Thelma Fardin que busca abrir esta conversación. A través de diálogos profundos, sensibles y cercanos, la serie retrata las múltiples barreras que atraviesan quienes han vivido violencia sexual y ofrece claves para transformar los sistemas de justicia desde un enfoque feminista, regional, y centrado en las víctimas.

Los diálogos están conducidos por Thelma Fardin, actriz, activista y sobreviviente argentina; y co-conducidos por Sofía Quiroga, oficial de incidencia de Equality Now en América Latina, y por Mónica Bayá, asesora legal de Equality Now.

JUSTAS reúne a sobrevivientes, juezas, fiscales, psicólogas y activistas de distintos países de América Latina y el Caribe – Argentina, Bolivia, Colombia, Ecuador, México, Puerto Rico y Uruguay – para abordar temas urgentes: las barreras que atraviesan las sobrevivientes al momento de denunciar, la violencia sexual en entornos digitales, la interseccionalidad como categoría clave para entender la discriminación en el acceso a la justicia, el enfoque de género en los procesos judiciales, las particularidades en los casos en que las víctimas son niñas y adolescentes, las distintas vías de reparación, el poder del acompañamiento y el rol de la comunidad.

Además de visibilizar los obstáculos que enfrentan las sobrevivientes, JUSTAS también busca romper con la cultura del silencio que rodea a la violencia sexual en la región, posicionando el tema en la agenda pública.

La serie consta de cinco episodios. El primero ya está disponible en Spotify.y YouTube, y los siguientes se publicarán semanalmente.

Una alianza para amplificar voces y transformar la justicia

En 2018, Thelma Fardin denunció públicamente haber sido violada en 2009 por el actor Juan Darthés durante una gira de un programa de televisión, cuando ella tenía 16 años y él 45. Su testimonio tuvo un efecto multiplicador en otras sobrevivientes, que la vieron emprender esta lucha y se animaron a denunciar. Las cifras oficiales dan cuenta de que las denuncias por abuso sexual infantil crecieron un 53% en Argentina en los meses posteriores.

Desde Equality Now, comenzamos en 2023 a colaborar con Thelma Fardín en distintos espacios de incidencia, incluyendo la presentación de un amicus curiae en su caso judicial en Brasil, instando a que se aplicaran los estándares internacionales de derechos humanos sobre el consentimiento en materia de violencia sexual, como aquellos establecidos por la Corte Interamericana de Derechos Humanos en el caso Brisa de Angulo vs. Estado de Bolivia, un caso que litigamos desde Equality Now junto a Brisa y su equipo legal.

En ese proceso, Thelma también decidió crear la Fundación Thelma Fardin, como parte de su compromiso por transformar su experiencia personal en una herramienta colectiva. La fundación trabaja para acompañar a otras sobrevivientes, sensibilizar a la sociedad sobre el impacto del abuso sexual, y promover una justicia que no revictimice a quienes denuncian.

De la articulación sostenida el diálogo constante entre Thelma Fardin y Equality Now, surgió una propuesta conjunta: crear un video podcast que reuniera las voces de quienes enfrentan, piensan, y transforman el sistema de justicia en la región de América Latina y el Caribe.

Muchas de las voces que forman parte de los episodios de  JUSTAS no llegan solo como invitadas: son aliadas clave en el trabajo que Equality Now viene desarrollando para transformar los sistemas de justicia en América Latina y el Caribe. Varias de ellas integran también la Red Regional de Acceso a la Justicia, una articulación impulsada por Equality Now desde 2023 que reúne a profesionales del derecho, operadoras judiciales y activistas de distintos países para intercambiar buenas prácticas, fortalecer la incidencia y promover reformas legales centradas en las sobrevivientes.

“Queremos poner las voces de las sobrevivientes de violencia sexual en el centro de la conversación pública, visibilizar las barreras que enfrentan y aportar a la construcción de buenas prácticas, articulando las perspectivas de la sociedad civil y del sistema judicial. JUSTAS es una forma de amplificar el trabajo que venimos haciendo con operadores de justicia y llevarlo a una audiencia más amplia. El podcast también muestra que, aunque las entrevistadas provienen de distintos países, comparten experiencias, desafíos y demandas similares. Este video podcast también representa un paso importante en la estrategia regional de Equality Now para acercar su trabajo de incidencia legal a una audiencia más amplia. A través de este formato, buscamos que los estándares internacionales de derechos humanos dejen de ser herramientas exclusivamente técnicas, y se conviertan en lenguaje común para sobrevivientes, comunidades y funcionarias que luchan por una justicia transformadora.
